1. Acceptance of these terms
By creating a Hemlead account or using https://hemlead.com or https://app.hemlead.com, you agree to these Terms & Conditions. If you're signing up on behalf of a company, you're confirming you have the authority to bind that company to these terms.
2. What Hemlead is
Hemlead is a lead management CRM built for sales teams, with features including lead capture, pipeline management, automation, and integrations with Meta, WhatsApp (via Interakt), email (via Brevo), and telephony providers. Our current plans — Trial, Essential, Enterprise, and White Label — are described in full on our pricing page, which is the current source of truth for pricing and plan limits.
3. Accounts and eligibility
- You must be at least 18 years old and able to enter into a binding contract to create a Hemlead account.
- You're responsible for keeping your account credentials secure, and for all activity that happens under your account.
- You agree to provide accurate account and billing information, and to keep it up to date.
4. Free trial
New accounts get a 14-day free trial of the Essential plan, with no card required up front. At the end of the trial, you'll need to choose a paid plan to continue using Hemlead. We don't automatically charge you when a trial ends — nothing is billed unless you actively choose and pay for a plan.
5. Subscriptions and billing
- Paid plans are billed on a recurring basis (monthly, or as otherwise stated at checkout) according to the plan you select.
- Prices for each plan are shown on our pricing page and may change over time — we'll give notice before a price change affects your existing subscription.
- You can cancel at any time from your account settings. Cancelling stops future billing; we don't offer refunds for partial billing periods already paid, except where required by law.
- White Label plans are priced individually and governed by the specific terms agreed at the time of signup.
6. Acceptable use
You agree not to use Hemlead to:
- Send unsolicited communications (spam) via WhatsApp, email, or telephony features in violation of applicable law.
- Upload or process data you don't have a lawful right to collect or use.
- Attempt to breach, disrupt, or gain unauthorised access to our systems or another customer's account.
- Reverse-engineer, resell, or misuse the platform outside of a properly licensed White Label arrangement.
- Use Hemlead for any unlawful purpose.
We reserve the right to suspend or terminate accounts that violate this section.
7. Your data
Your leads' data belongs to you. Hemlead stores and processes it on your behalf to provide the service — we don't claim ownership of your customer or lead data, and we don't use it for our own purposes. See our Privacy Policy for the full detail on how data is handled.
You're responsible for having a lawful basis to collect, store, and process the lead data you upload to Hemlead, and for complying with applicable data protection law in how you use the platform.
8. Our intellectual property
Hemlead — including the software, design, branding, and content on https://hemlead.com — is owned by us and protected by applicable intellectual property law. These terms don't grant you any ownership rights in the platform itself, only a licence to use it as intended for the duration of your subscription.
9. Third-party integrations
Hemlead integrates with third-party services including Meta, Google, Interakt (WhatsApp), Brevo (email), and telephony providers. Your use of those integrations may also be subject to that third party's own terms. We're not responsible for outages, changes, or issues originating from a third-party service outside our control.
10. Service availability
We aim to keep Hemlead available and reliable, but we don't guarantee uninterrupted access. We may need to perform maintenance, and we may update or change features over time as the product improves. We'll aim to give reasonable notice of any change that materially affects how you use the platform.
11. Cancellation and termination
- You can cancel your subscription at any time from your account settings.
- We may suspend or terminate an account that violates Section 6 (Acceptable Use), or for non-payment, after reasonable notice where practical.
- On cancellation or termination, you can export your data — see our Privacy Policy for how long data is retained afterward, and our account deletion page if you'd like data removed sooner.
12. Disclaimer of warranties
Hemlead is provided "as is." To the extent permitted by law, we don't offer warranties of any kind, express or implied, including warranties that the service will be error-free, uninterrupted, or fit for a particular purpose.
13. Limitation of liability
To the extent permitted by applicable law, Hemlead and its team won't be liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim relating to Hemlead is limited to the amount you paid us in the twelve months before the claim arose.
14. Indemnification
You agree to indemnify and hold Hemlead harmless from claims arising out of your misuse of the platform, your violation of these terms, or your violation of applicable law in how you collect or process data through Hemlead.
15. Governing law
These terms are governed by the laws of India. Any disputes arising from these terms or your use of Hemlead will be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
16. Changes to these terms
We may update these terms from time to time as our product or legal obligations evolve. We'll update the "Effective date" at the top of this page when we do, and for significant changes, we'll make a reasonable effort to notify customers directly.
